Competition law advisory for the Media sector in Türkiye.

Media

The media sector brings together content production, the distribution of content rights, advertising, digital platforms, broadcasting technologies and creative labour markets within the same economic structure. The convergence of traditional television and cinema models with digital streaming platforms and social media channels is creating new competitive dynamics for both content producers and distribution companies.

Content licensing and distribution agreements, exclusivity provisions, collaborations between production companies, digital advertising and measurement systems, access to platforms and inter-company practices concerning skilled professionals involved in content production may intersect with different areas of competition law. The Turkish Competition Authority has also placed conduct relating to production, distribution, digital services and labour markets in the media sector on its enforcement agenda. Although the opening of an investigation does not in itself constitute a finding of infringement, the issues being examined provide an indication of the sector's current competition law agenda.

KFD Consulting assesses the content production and distribution models of media companies alongside the sector's creative and commercial requirements. In particular, the appropriate limitation of information flows between competitors or commercial partners, the scope of exclusivity arrangements concerning content rights and the competitive effects of platform relationships may be analysed before the relevant agreements are concluded.
