Competition law advisory for the Software and Technology sector in Türkiye.

Software and Technology

Competitive dynamics in software and technology markets can change far more rapidly than in traditional sectors. Low marginal costs, high scalability, network effects, accumulation of data and users becoming dependent on particular ecosystems can enable a small start-up to become a significant market participant within a relatively short period, while also reinforcing the advantages enjoyed by established platforms.

API access, data portability, interoperability, software licensing, cloud services, platform access, algorithmic ranking and conditions imposed on third-party developers are becoming increasingly important from a competition law perspective. Acquisitions involving technology companies also require particular attention; Türkiye's merger control regime contains specific provisions relating to technology undertakings, and the merger and acquisition framework was further updated in 2026.

KFD Consulting integrates competition law analysis not only into the contractual processes of technology companies, but also into product and business-model design. Decisions that may appear primarily technical (such as the conditions under which an API will be opened, which user groups will have access to particular data or how a platform positions its own service) may have significant competition law consequences. It is therefore important for legal, product and commercial teams to be able to assess these issues within the same decision-making process.
